Australian Privacy Principles (APPs)

Definition

The Australian Privacy Principles (APPs) are a set of principles that regulate the handling of personal information by organisations in Australia.

What are the Australian Privacy Principles?

The APPs establish standards for the collection, use, disclosure, and management of personal information to protect the privacy rights of individuals. They apply to Australian government agencies and private sector organisations with an annual revenue of $3 million or more, as well as certain other entities

The key aspects of the Australian Privacy Principles are:

  • Collection of personal information: The first principle requires organisations to collect only necessary personal information for their activities, ensuring transparency about the collection process and purposes.
  • Use and disclosure: The second principle requires organisations to use personal information only for its intended purpose, with exceptions.
  • Data security and integrity: The third principle requires organisations to safeguard personal information from misuse, loss, and unauthorised access through security measures.
  • Access and correction: The fourth principle gives individuals the right to access their personal information held by organisations, ensuring prompt access and correction upon request.
  • Anonymity: The fifth principle allows individuals the option of dealing with organisations anonymously, unless there is a legal or practical requirement for identification.
  • Sensitive information: The sixth principle oversees the treatment of sensitive data, like health records, ethnicity, politics, and religion, imposing extra conditions on their management.
  • Cross-border disclosure: The seventh principle governs the sharing of personal information with international parties, demanding organisations adhere to similar privacy standards or equivalent laws.
  • Privacy policies and procedures: The eighth principle requires organisations to maintain a transparent privacy policy detailing their data handling practices.

Example of the Australian Privacy Principles

ABC Company, an online retailer, ensures compliance with the Australian Privacy Principles by providing a clear and accessible privacy policy on its website. This policy outlines how customer information is collected, used, and protected. Additionally, ABC Company has internal procedures in place to address any privacy complaints or inquiries from customers promptly.
