It requires that marketers obtain consent from individuals before sending them electronic marketing messages. Additionally, marketers must provide clear and easy-to-use unsubscribing methods for recipients who no longer wish to receive such communications.

Additionally, PECR covers the use of cookies and similar technologies on websites and other electronic services. It requires that website managers inform users about the use of cookies, what they are used for, and obtain consent from users before placing non-essential cookies on their devices. 

Furthermore, PECR includes regulations aimed at protecting the privacy and security of electronic communications. It regulates the use of technologies such as email tracking, location tracking, and electronic monitoring to safeguard individuals’ rights to privacy in their electronic communications.

Non-compliance with PECR can result in enforcement actions, including fines and penalties.

Example of the Privacy and Electronic Communications Regulations 

Let’s say a marketing company wants to send promotional emails to individuals who have signed up for their newsletter. Under PECR, the company must make sure they have gotten consent from each recipient before sending them marketing emails.

In compliance with PECR, the company sends an initial email to its subscribers, clearly explaining the purpose of the email and providing an option to unsubscribe. Recipients who wish to continue receiving emails can choose to remain subscribed, while those who no longer want to receive them can easily unsubscribe. The company respects these preferences and updates its mailing list accordingly, ensuring compliance with PECR’s requirements for electronic marketing communications.
